Membership Agreement
The following is a binding agreement between you ("enrollee") and the International Board of Coaches and Practitioners ("IBCP") upon enrollment as a Member. By enrolling as a member, you indicate consent with this agreement. You also acknowledge and accept the terms of this agreement for any and all other accounts you may enroll under in the future.
Should you need to cancel your membership, our refund agreement reflects the fact that we deliver most of the value of your membership and incur most of the expenses of your membership the moment you apply.
IBCP reserves the right to cancel your membership and demand your certificates to be returned within 15 days for any reason, including but not limited to violations of our Code of Professional Ethics.
All cancellation requests must be submitted to IBCP in writing via written letter or confirmed fax. While voicemail will not be an accepted method of cancellation, enrollees may call and speak to an IBCP representative for consultation. Cancellation will be considered official from the date written confirmation is received by the IBCP.
You agree that the certificates issued to you are the intellectual property and copyrighted works of IBCP, licensed to you for your professional use only during your valid, active membership. If your membership is cancelled by either party or your payments lapse, you agree to mail the original certificates back to IBCP within 15 working days and remove all references to IBCP in enrollee’s marketing or submit a licensing fee of $100 per month until returned.
Our Membership Cancellation agreement is as follows:
0-10 days from enrollment: Full refund available (must return certificates for refund)
11+ days from enrollment: Cancellation only. No refund available.
Payment Due
Minimum payment is due immediately upon enrollment. No membership will be held without payment. Your payments will be drawn against your credit card each month on the same day.
If the enrollee should default on any payment, the enrollee will have ten (10) days to rectify the situation. If the situation is not rectified in the time given, membership will be terminated, and the enrollee shall be required to send the original certificates back, destroy any copies or facsimiles, and removal all references to IBCP from enrollee’s marketing. An NSF returned check or declined credit card charge will carry a fee of $50.
Jurisdiction and Venue
The courts of Los Angeles County in the State of California, USA and the nearest U.S. District Court in the State of California shall be the exclusive jurisdiction and venue for all legal proceedings that are not arbitrated under these Terms of Use.
Controlling Law
This Agreement shall be construed under the laws of the State of California, USA, excluding rules regarding conflicts of law. The application the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded.
Severability
If any provision of these terms is declared invalid or unenforceable, such provision shall be deemed modified to the extent necessary and possible to render it valid and enforceable. In any event, the unenforceability or invalidity of any provision shall not affect any other provision of these terms, and these terms shall continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as above provided, as the case may be.
Force Majeure
We shall not be liable for damages for any delay or failure of delivery arising out of causes beyond our reasonable control and without our fault or negligence, including, but not limited to, Acts of God, acts of civil or military authority, fires, riots, wars, embargoes, Internet disruptions, hacker attacks, or communications failures.
